Postdoctoral Researcher Received EB2NIW Approval in 3 Months 15 Days
On October 23, 2008, we helped a postdoctoral researcher receive CIS approval of his EB2NIW application in 3 months and 15 days. This application was submitted to the CIS Texas Service Center on July 8, 2008 and TSC approved the application without a request for evidence (RFE). The applicant was a postdoctoral researcher at MIT (Massachusetts Institute of Technology). He did not have a permanent job at the time of filing and had J1 status. We helped him prepare and file a self-petition green card application under the EB2NIW category.
His research was in the area of organic chemistry, organometallic chemistry, transition metals catalysis and green chemistry. He obtained both his Ph.D. and Master’s degrees in other countries, without any academic degrees obtained within the United States. We made a strong legal argument that the applicant played a critical role in the National Institutes of Heath - National Institute of General Medical Sciences (NIH-NIGMS) funded research projects focusing on green chemistry. The applicant was also awarded the prestigious 2007 Presidential Green Chemistry Challenge Award by the U.S. Environmental Protection Agency (EPA). Additionally, he had published research articles in Organometallics, Synthesis, Topics in Current Chemistry and twice in Angewandte Chemie International Edition. At the time of filing, he had 9 published scientific papers, which generated about 85 citation papers authored by other scientists around the world. Furthermore, various public media, such as Chemical and Engineering News, EPA Newsroom, ChemAlliance.org, Mywire.com, The University of Texas at Austin, and Focus on Science, published news reports about the research being conducted at the applicant’s MIT laboratory as well as awards the Principal Investigator of the lab received due to the pollution prevention innovations (applicant played a critical role and made significant contributions to this project). Our law firm also helped the applicant prepare and submit strong and well- written expert opinion letters. After our meticulous documentation of his EB2NIW, we submitted his application to the CIS Texas Service Center. Currently, CIS Texas Service Center reports a 16-month processing time for EB2NIW. However, this EB2NIW application, which was prepared and submitted by our law firm in July 2008, was approved by CIS Texas Service Center in 3 months and 15 days! This rapid approval clearly proves that the case was well organized and well -prepared, which is critical for successful petition results. Due to the current economic down-turn in the United States, many U.S. employers require job applicants to have green cards. No green card, no job offer. The primary reason for this new trend is that the U.S. Department of Labor has placed a heavy financial and administrative burden on U.S. employers which sponsor green card applications for their foreign employees. Now, more and more private companies are requiring that their job applicants already have a green card. In addition, many governmental research institutions also require green cards due to national security concerns. As a result, it has become increasingly difficult for foreign Ph.D . students and postdoctoral researchers to find a permanent job in the United States if they do NOT have green card.
Therefore, it is very important to apply for U.S. Permanent Residence as early as possible when you are a qualified Ph.D. student or a qualified postdoctoral researcher.
